بيان السفيرة باور حول تبني الجمعية العامة للأمم المتحدة قراراً بإنشاء آلية للمساعدة في مقاضاة المسؤولين عن الجرائم المرتكبة في #سوريا منذ آذار/مارس عام 2011:
على مدى ما يقرب من ست سنوات، شهدنا فظائع لايمكن تصورها تحدث في سوريا: إعتقالات غير قانونية تتضمن في الغالب أعمال تعذيب، وإغتصاب، أو قتل؛ هجمات بالأسلحة الكيميائية؛ إستخدام تكتيكات الحصار والتجويع؛ والقصف الجوي العشوائي.
ويواصل النظام السوري إنكار حدوث تلك الأعمال الوحشية.حيث يبدو أن بشار الاسد وأعوانه يعتقدون على نحو متزايد انهم لا يمكن المساس بهم. لكن لحسن الحظ، فإن لجنة تقصي الحقائق الخاصة بسوريا وجهات أخرى من داخل وخارج الأمم المتحدة تكشف بشكل شامل أن تلك الانكارات هي محض أكاذيب.
فقد عملت دول ومنظمات مجتمع مدني، إلى جانب لجنة تقصي الحقائق على جمع المعلومات عما يجري في سوريا منذ عام 2011. وإن الولايات المتحدة تشيد بهذه الجهود، وخصوصاً تلك المبذولة من قبل لجنة تقصي الحقائق والمنظمات المستقلة والمحايدة مثل المركز السوري للمساءلة والعدالة، ولجنة المساءلة والعدالة الدولية ومنظمات المجتمع المدني المحلية في أنحاء سوريا. ذلك أنهم يعملون جاهدين لتوثيق وحماية المعلومات المتعلقة بالإنتهاكات الكثيرة للقانون الدولي وما يحدث من إنتهاكات وخروقات لحقوق الانسان أثناء هذا الصراع. لكن لايزال هناك عمل كثير يتعين القيام به لتوحيد هذه الجهود وتهيئة المعلومات ذات الصلة للإجراءات القضائية المستقبلية– مثل تزويد المحاكم ذات الإختصاص بالأدوات اللازمة للسير في هذه القضايا بشكل فعال.
إن قرار الجمعية العام للامم المتحدة بإنشاء آلية تحت رعاية الأمم المتحدة هي خطوة في هذا الإتجاه وتبعث برسالة مهمة الى بشار الاسد والمسؤولين عن ارتكاب الجرائم مفادها: إنكم ستحاسبون. وإن الأدلة على الفظائع المرتكبة لن تمحى. فالعالم مايزال يراقب، وكما قال الرئيس أوباما مؤخراً، ” قد تتحقق بعض الإنتصارات التكتيكية، لكن على المدى الطويل لا يمكن لنظام الأسد أن يكسب الشرعية عن طريق ارتكاب المجازر.”
من المحتمل أن يكون عمل هذه الآلية تقنياً ويجري بصورة رئيسية خلف الكواليس. لكنه ينطوي على إمكانية للعب دور حاسم في تسهيل ما نعلم جميعاً انه لابد أن يأتي – وهو المحاسبة على ما جرى في سوريا.
Statement on the Adoption of a Resolution on a Mechanism to assist in the Investigation and Prosecution of those Responsible for the Most Serious Crimes under International Law committed in the Syria since March 2011:
For nearly six years, we have seen a catalogue of unthinkable atrocities in Syria: illegal detentions, too often involving torture, rape, or murder; chemical weapons attacks; the use of siege-and-starve tactics; and indiscriminate aerial bombardment. In fact, the origin of the conflict lies in one such atrocity – the targeting of peaceful protesters.
The Syrian regime continues to deny that these atrocities are happening. Assad and his cronies increasingly appear to think they are untouchable. Thankfully, the Human Rights Council Commission of Inquiry (COI) on Syria and others both inside and outside the UN have comprehensively exposed these denials for the lies they are.
States, civil society, and the COI have been gathering information about what has transpired in Syria since 2011. The United States applauds these efforts, in particular of the COI and of independent and impartial organizations such as the Syria Justice and Accountability Centre, Commission of International Justice and Accountability, and local civil society organizations across Syria. They work tirelessly to document and safeguard information regarding the numerous violations of international humanitarian law and violations and abuses of human rights during this conflict. Yet more must still be done to draw these efforts together and prepare relevant information for future court proceedings – providing courts that already have jurisdiction with the tools to pursue cases effectively.
The UN General Assembly resolution adopted today to establish a mechanism under the auspices of the United Nations is a step in this direction and sends an important message to Assad and those responsible for crimes: you will be held to account. Evidence of atrocities will not be swept away. The world is still watching. As President Obama recently said, “although you may achieve tactical victories, over the long term the Assad regime cannot slaughter its way to legitimacy.”
This mechanism’s work will likely be technical and reside mainly behind the scenes. But it has the potential to play a crucial role in facilitating what we all know must come – a reckoning for what has happened in Syria
