1750 محام عراقي وعربي يوقعون لائحة يطالبون فيها باطلاق سراح الرهائن الأشرفيين السبعة عشية اليوم الـ72 من اضراب الطعام

الرهائن هم أفراد محميون تحت اتفاقية جنيف الرابعة وطالبو لجوء

أعلن 13 تجمعا حقوقيا ومنظمات مدافعة عن حقوق الانسان دعمهم للمناشدة التي أطلقها 1750 محام من العراق ومصر والاردن واليمن والعربية السعودية والفلسطين و السورية.
الموقعون على المناشدة نددوا بالهجوم الوحشي الذي شنته قوات المالكي على سكان أشرف في الأول من ايلول/ سبتمبر مما أدى الى مجزرة طالت 52 من سكان أشرف واحتجاز 7 آخرين وطالبوا بالافراج الفوري عنهم.
المناشدة تؤكد ان جميع سكان أشرف كانوا أفرادا محميين تحت اتفاقية جنيف الرابعة وأفراد طالبي لجوء معروفين تكفلهم قوانين الحماية الدولية. القوات المهاجمة العراقية قتلت بدم بارد وقسوة لا نظير لها السكان بينما العديد منهم كانوا مكبلي الأيدي وأطلقت عليهم رصاصات الرحمة كما اقتحمت مستوصف المخيم حيث نقل عدد من الجرحى لتلقي العلاج وقتلت جميع الجرحى.
المضربون عن الطعام في ليبرتي ودول سويسرا واستراليا وبريطانيا وألمانيا … يعيشون عشية اليوم الاثنين والسبعين من اضرابهم. الحالة الصحية لهم آخذة بالتدهور وأن أمريكا والأمم المتحدة تتحملان المسؤولية تجاه أي كارثة تقع للمضربين كونهما قد تعهدتا تجاه أمن و سلامة سكان مخيم أشرف.
وتؤكد المناشدة الموقعة على المواد والمطالب التالية:
ندعو الرئيس اوباما وجون كيري وزير الخارجية الأمريكي وبان كي مون الأمين العام للأمم المتحدة وبيكروفت سفير أمريكا في العراق الى تذكير الحكومة العراقية بمسؤولياتها تجاه أمن وسلامة الرهائن والضغط عليها لاطلاق سراح الرهائن في أسرع وقت. كل الأدلة والشهود تؤكد على أن الرهائن هم محتجزون في العراق في قبضة القوات المؤتمرة بإمرة المالكي ويجب اطلاق سراحهم فورا.
نظرا الى أن الرهائن السبعة هم أفراد محميون وتحميهم اتفاقية جنيف الرابعة وعلى ضوء أن المفوضية العليا لشؤون اللاجئين أعلنتهم طالبي لجوء معروفين وتحميهم القوانين الدولية ونظرا الى أن وجودهم في أشرف كان قانونيا وحسب توافق رسمي، لذلك تتحمل أمريكا والأمم المتحدة والحكومة العراقية المسؤولية تجاه أمن وسلامة ومصير الرهائن وأن الأطراف المعنية يجب أن تسخر كل طاقاتها السياسية والحقوقية لاطلاق سراح الرهائن في أسرع وقت.
اننا نطالب جميع الجهات المدافعة عن حقوق الانسان والناشطة في المجال الانساني الدولي وسيما العربي أن يعبروا بملء الفم عن احتجاجهم وادانتهم لعملية حجز حكومي للرهائن من قبل الحكومة العراقية وأن يستخدموا كل اعتبارهم ونفوذهم لاطلاق سراح الرهائن الأشرفيين السبعة في أسرع وقت.

1,750 Iraqi and Arab lawyers sign a petition demanding the release of 7 Ashrafi hostages on the brink of the 72nd day of a global hunger strike
13 legal associations and human rights organizations expressed their support for this call
The hostages are ‘Protected Persons’ under the 4th Geneva Convention & asylum seekers
Six of the hostages are women
Thirteen legal associations and human rights organizations expressed their support for a call made by 1,750 lawyers from Iraq and the countries of Egypt, Jordan, Yemen, Saudi Arabia, Palestine and Syria.
The signatories of this call condemned the vicious 1 September 2013 attack by Maliki’s forces against Ashraf residents that led to the massacre of 52 people and 7 others taken hostage. The signatories also called for the immediate release of the hostages.
This call emphasizes Ashraf residents are ‘Protected Persons’ under the 4th Geneva Convention, asylum seekers and ‘person of concern’ under the international law. The attacking Iraqi forces resorted to unprecedented brutality in killing many of the victims while their hands were tied behind their backs and shooting them in the heads execution style. The assailants also stormed the Camp Ashraf clinic where a number of wounded residents were transferred to, slaughtering all the injured residents inside.
Hunger strikers in Liberty and the countries of Switzerland, Australia, United Kingdom, Germany and … are on the verge of the 72nd day of hunger strike as their conditions have deteriorated. The responsibility of any catastrophe for the hunger strikers lies on the shoulders of the United States and United Nations who have undertaken the safety and security of Ashraf residents.
This signed petition stresses the followings:
1. We call on President Obama, US Secretary of State John Kerry, United Nations Secretary-General Ban Ki-moon and US Ambassador to Iraq Robert Beecroft to remind the Iraqi government of its responsibilities regarding the safety and security of the hostages and pressure this government to release the hostages as soon as possible. All the signs and evidence indicate these hostages are in Iraq and under the custody of forces commanded by Maliki, and they must be released immediately.
2. Considering the fact that the 7 hostages are ‘protected persons’ and covered by the 4th Geneva Convention, and considering the fact that the UNHCR has announced them as asylum seekers, persons of concern covered by international law, and considering the fact that their presence in Ashraf was completely legal and under a formal agreement, therefore the US, UN and Iraqi government are responsible in the face of their safety and security and the relevant parties must use all their political and legal capacities to have the hostages released as quickly as possible.
3. We call on all international human rights and humanitarian organizations, and especially Arab organizations, to voice their strongest protests condemning the state hostage taking by the Iraqi government, and use all their influence to have the 7 Ashrafi hostages released as soon as possible.
